Anti Drug Alliance South Africa

General Terms and Conditions

Valid as of 1 June 2013

The following are the basic terms and conditions of conducting business with the Anti Drug Alliance South Africa.

In the absence of a signed contract which may have different terms and conditions, the following will henceforth be the terms and conditions of business transactions with the Anti Drug Alliance South Africa.

The Anti Drug Alliance South Africa owns and operates the Clear Option Program and Test 24, and thus any terms and conditions hereunder would immediately cover any transactions made by the Clear Option and Test 24 as well.

“The Anti Drug Alliance South Africa” means the organisation, its employees, directors, agents or any person or persons that may be contracted to do work for the Anti Drug Alliance South Africa from time to time.

The Anti Drug Alliance South Africa is hereby indemnified against any action by any person, persons or entities that henceforth do business with the Anti Drug Alliance South Africa and do not sign written contracts which may have different terms and conditions, and by making payment as a client, or supplying products or services as a vendor without a written contract, the client or vendor agrees unequivocally to the following terms and conditions.

Clients

Clients are any person, persons or entities paying the Anti Drug Alliance South Africa for any service or product that the Anti Drug Alliance South Africa offers. These products and services may differ from time to time.

By making payment to the Anti Drug Alliance South Africa, the client unequivocally agrees to the following:

  1. No refunds will be made under any circumstances;
  2. No product will be delivered or handed over, and no service will be given until full payment has been received. This includes transactions where third party service providers may also be involved;
  3. No cheques will be accepted, unless otherwise agreed upon by management;
  4. If a time frame has been agreed upon, and service has not been completed within that time frame, it is within management's discretion to charge for further service;
  5. The client herewith fully indemnifies the Anti Drug Alliance South Africa against any action, either civil or criminal, that may arise from any transactions between the client and the Anti Drug Alliance South Africa, and the client furthermore unequivocally gives up their right to bring such action against the Anti Drug Alliance South Africa;
  6. The client agrees to keep confidential any and all transactions with the Anti Drug Alliance South Africa;
  7. Should the transaction be unsatisfactory or end unsatisfactorily to the client, the client agrees to advise the Anti Drug Alliance South Africa thereof in writing. The board of the Anti Drug Alliance South Africa meets twice yearly, and such matters will be discussed at this time. The board's decision is final, and the client unequivocally gives up their right to take action against the Anti Drug Alliance South Africa should the decision not be in favour of the board's decision.

Vendors

A vendor is any person, persons or entities that supply services or products to the Anti Drug Alliance South Africa, either occasionally or on a long term basis. The vendor agrees to the following:

  1. The Anti Drug Alliance South Africa will not make payment for any product or service until funds are available to do so. It may be that as a vendor, you have supplied the Anti Drug Alliance South Africa with a product or service as part of a bigger transaction. You will only receive payment once the Anti Drug Alliance South Africa has received full payment from the entity which is paying for the services;
  2. The vendor unequivocally gives up their right to take any form of action against the Anti Drug Alliance South Africa should the Anti Drug Alliance South Africa not receive full payment.

The terms and conditions in this document may change from time to time, and such changes will be published on the website of the Anti Drug Alliance South Africa.
